High Court judge Justice Francis Bere refused to hear the case and dismissed the application with costs on the basis the party had failed to prove its urgency.
Following the dismissal of the Movement for Democratic Change’s urgent chamber application Wednesday to overturn the government’s refusal to allow the appointment of officials who were not elected in local government elections on July 31 as mayors in urban areas, the party vowed Thursday it will not rest until the matter is resolved.

High Court judge Justice Francis Bere refused to hear the case, and dismissed the application with costs on the basis the party had failed to prove its urgency.

The MDC-T nominated party official Obert Gutu and National University of Science and Technology (NUST) lecturer Mandla Nyathi as new mayors for Harare and Bulawayo respectively.

MDC-T deputy spokesman Joel Gabhuza said the party will re-strategise to prove to the High Court that the case is extremely urgent.
